1. About us and these terms
1.1 These terms of use (the Terms) govern your use of the website at asknuala.ie and any related Ask Nuala web pages (the Website), including our Care advice articles and our care provider search. Please read them carefully. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
1.2 The Website is operated by Ask Nuala Limited (Ask Nuala, we, us or our), a private company limited by shares registered in Ireland under company number [CRO number], with its registered office at 26 Berkeley Road, Phibsborough, Dublin D07 CH64.
1.3 You can contact us using the contact us page.
1.4 These Terms cover the Website only. If you buy one of our services — for example care advice, a care availability search, odd jobs and errands, accompanied transport or a smart bracelet — that service will be governed by a separate agreement that you will be asked to accept before the service starts (a Service Agreement). See clause 7.
1.5 We use plain English in these Terms. The headings are for convenience only. Words such as “including” and “for example” do not limit the words that come before them.
2. Who the Website is for
2.1 The Website is intended for adults (aged 18 or over) in the Republic of Ireland, principally family members and friends who are organising care and support for an older relative. Older adults are welcome to use the Website for their own planning.
2.2 The information on the Website relates to services, schemes and entitlements in the Republic of Ireland. If you access the Website from elsewhere, including Northern Ireland, please be aware that it may not apply to you.
3. What the Website is — and what it is not
3.1 The Website provides general information to help you understand your options when arranging care and support for an older person. It is not tailored to anyone’s individual circumstances.
3.2 Ask Nuala is a non-medical service. Nothing on the Website is, or is intended to be, medical, clinical, nursing, psychological, legal, financial, tax or other regulated professional advice, and it should not be relied on as a substitute for that advice. Always speak to a GP, public health nurse, pharmacist, solicitor, financial adviser or other appropriate professional about decisions affecting a person’s health, legal position or finances.
3.3 The Website is not an emergency service. If someone is in immediate danger or needs urgent medical help, call 112 or 999. If you are worried that an older person is being harmed or exploited, contact the HSE Safeguarding and Protection Team for the area or An Garda Síochána.
3.4 Using the Website, reading our content or submitting an enquiry does not by itself create an advisory, professional or contractual relationship between you and Ask Nuala beyond these Terms.
4. Care advice articles
4.1 Our Care advice section contains articles, guides and checklists written to help families navigate care in Ireland (Care advice).
4.2 We take care to make Care advice accurate and useful at the date it is published. However, public schemes, eligibility rules, charges and waiting times — for example Home Support, the Nursing Homes Support Scheme (Fair Deal), carer’s payments and housing adaptation grants — change frequently. Articles may become out of date and we do not promise to update them. Please check the current position with the relevant body (such as the HSE, the Department of Social Protection, Citizens Information or your local authority) before acting.
4.3 Where an article is written by, or features, a guest contributor, the views expressed are those of the contributor and not necessarily those of Ask Nuala.
4.4 Care advice may mention products, services or organisations as examples. A mention is not an endorsement or a recommendation that a product or service is suitable for you.
5. Care provider search and directory
5.1 The Website includes a free search tool and directory of home care providers, nursing homes and related services (the Directory).
5.2 Directory information is compiled from publicly available sources — including registers and lists published by the HSE and HIQA — from providers themselves, and from our own enquiries. Where we can, we show the source of information and when it was last checked.
5.3 We try to keep the Directory accurate and up to date, but we cannot guarantee that any listing is complete, current or correct. In particular, availability, waiting times, prices, services offered and regulatory status can change at short notice. Please confirm all details directly with the provider before making any decision.
5.4 Inclusion in the Directory, or the order in which results appear, is not a recommendation, endorsement or guarantee of the quality, suitability, safety or standards of any provider.
5.5 Any arrangement you make with a provider is between you (or the person receiving care) and that provider. Ask Nuala is not a party to it and is not responsible for the provider’s services, acts or omissions. You are responsible for choosing a provider and for carrying out any checks you consider appropriate, such as checking Garda vetting, insurance, references, contracts and the latest HIQA inspection report where relevant.
5.6 Care providers: if you believe information about your organisation is inaccurate, or you would like a listing reviewed, please contact us using the contact us page. We will review requests promptly, but we decide what appears in the Directory.
6. Our independence
6.1 Ask Nuala is independent of the care providers and suppliers listed on or referred to on the Website.
6.2 We do not accept payment from care providers to be listed in the Directory or to influence where they appear in search results.
7. Paid services
7.1 The Website describes paid services that Ask Nuala offers. Descriptions and prices on the Website are for information and are not an offer capable of acceptance. A contract for a paid service is formed only when you accept our Service Agreement for that service and we confirm your booking in writing.
7.2 Each Service Agreement sets out the service, the price, payment terms, your cancellation rights and our responsibilities for that service. If there is any conflict between these Terms and a Service Agreement, the Service Agreement will apply to that service.
7.3 We make every effort to keep prices on the Website accurate. If a price displayed on the Website is wrong, we will tell you the correct price before you commit to anything.
8. Information you give us
8.1 If you contact us, submit an enquiry, use the search tool or sign up for updates, you agree that the information you provide is accurate and that you are entitled to share it.
8.2 If you give us information about another person — for example the relative you are arranging care for — you confirm that you are entitled to do so and, where appropriate, that you have told them or have their agreement. Please share only what we need to respond to your enquiry. Do not send us detailed medical records through the Website.
8.3 We handle personal data in line with the General Data Protection Regulation, the Data Protection Acts 1988 to 2018 and our Privacy Policy (see clause 15).
10. Acceptable use
10.1 You may use the Website only for lawful purposes and in line with these Terms. You must not:
- use the Website in any way that breaches any law or regulation, or that is fraudulent or harmful;
- copy, scrape, extract, harvest or re-use the Directory or any substantial part of the Website’s content, whether manually or by automated means (including bots, crawlers or scripts), except for normal search-engine indexing;
- use the Website or its content to build a competing directory or service, or to train or improve any artificial intelligence or machine-learning model;
- post or transmit anything that is defamatory, abusive, discriminatory, obscene, misleading or that infringes anyone’s rights, including their privacy;
- impersonate any person, or misrepresent your connection with any person or organisation;
- introduce viruses, malware or other harmful material, or attempt to gain unauthorised access to the Website, its servers or any connected system;
- interfere with or disrupt the Website, including by overloading it or attempting a denial-of-service attack;
- use the Website to send unsolicited marketing to providers, users or anyone else.
10.2 If you breach this clause, we may suspend or withdraw your access to the Website and take any other action we consider appropriate, including reporting the matter to the relevant authorities.
11. Intellectual property
11.1 The Website and its content — including text, articles, graphics, logos, design, software, and the selection and arrangement of the Directory — are owned by or licensed to Ask Nuala and are protected by copyright, database rights, trade mark and other intellectual property laws.
11.2 You may view, print and download extracts from the Website for your own personal, non-commercial use, and share links to our pages. You may not otherwise copy, modify, republish, sell or commercially exploit any part of the Website without our prior written permission.
11.3 If you share or print our content, you must not change it, must not use any illustrations or images separately from the accompanying text, and must acknowledge Ask Nuala as the source.
11.4 “Ask Nuala”, the Ask Nuala logo and “We’re there when you can’t be” are trade marks of Ask Nuala Limited. You may not use them without our permission.
11.5 Some material on or linked from the Website — for example HIQA inspection reports and HSE data — belongs to third parties and remains their property. It is used under the terms on which those bodies make it available.
12. Links
12.1 The Website contains links to other websites, including public bodies, charities and care providers. These links are provided for your information only. We have no control over those sites and are not responsible for their content, availability or privacy practices. A link is not an endorsement.
12.2 You are welcome to link to the Website’s home page or any article, provided you do so fairly and lawfully and do not suggest any association with or endorsement by Ask Nuala that does not exist. You must not frame the Website on another site. We may withdraw linking permission at any time.
13. Nuala, our online assistant
13.1 The Website may offer an online assistant (“Nuala”) that uses artificial intelligence to answer questions and help you find information on the Website. When you use it, you are interacting with an automated system, not a person.
13.2 Responses are generated automatically and may be incomplete, out of date or wrong. They are general information only and are subject to clause 3. Please check anything important with us or the relevant body before relying on it.
13.3 Please do not share more personal information in the assistant than you need to, and do not share detailed health information. Conversations may be recorded and reviewed to improve the service, as explained in our Privacy Policy.
14. Our responsibility to you
14.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Irish law. Nothing in these Terms affects your statutory rights as a consumer, including under the Consumer Rights Act 2022.
14.2 The Website is provided free of charge and on an “as is” and “as available” basis. We do not guarantee that it will always be available, uninterrupted, secure or free from errors or viruses. You should use your own virus protection.
14.3 Subject to clause 14.1, we are not liable for any loss or damage arising from:
- decisions you make, or actions you take or do not take, based on content on the Website, including Care advice, the Directory and any responses from our online assistant;
- the services, acts or omissions of any care provider, supplier or other third party found through, listed on or linked from the Website;
- any interruption to, or unavailability of, the Website;
- any loss that was not reasonably foreseeable when you started using the Website.
14.4 If you use the Website for business purposes, we are not liable to you for any loss of profit, revenue, business, contracts, goodwill or anticipated savings, or for any indirect or consequential loss.
14.5Subject to clause 14.1, our total liability to you arising from your use of the Website is limited to €100.
14.6 Our responsibility for any paid service is set out in the relevant Service Agreement, not in this clause.
15. Privacy and cookies
15.1 Our Privacy Policy explains how we collect and use personal data, and your rights.
16. Changes to the Website and to these Terms
16.1 We may update, change, suspend or withdraw all or part of the Website at any time, for example to reflect changes to our services or to public schemes.
16.2 We may revise these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date and will apply from the time it is posted. Please check this page from time to time. If we make a significant change, we will highlight it on the Website.
17. Questions and complaints
17.1 If you have a question or concern about the Website, please contact us using the contact form. We aim to acknowledge complaints within 3 working days and to respond fully within 15 working days.
17.2 Complaints about a paid service are handled under the relevant Service Agreement.
18. General
18.1 If any part of these Terms is found to be invalid or unenforceable, the rest will continue to apply.
18.2 If we delay or do not enforce any of these Terms, that does not mean we have waived our rights.
18.3 These Terms are between you and us. No other person has any right to enforce them.
18.4 We may transfer our rights and obligations under these Terms to another organisation, for example if the Website or our business is transferred.
18.5 These Terms, together with the documents referred to in them, are the entire agreement between you and us about your use of the Website. They do not affect any Service Agreement.
19. Governing law and jurisdiction
19.1 These Terms, and any dispute or claim arising out of or in connection with them or your use of the Website, are governed by the laws of Ireland.
19.2 The courts of Ireland will have jurisdiction. If you are a consumer living in another EU member state, you may also bring proceedings in the courts of the country where you live, and you keep the protection of any mandatory consumer law of that country.
